Customer\/Subscriber understands, acknowledges,<!-- [et_pb_line_break_holder] -->    and<!-- [et_pb_line_break_holder] -->    agrees<!-- [et_pb_line_break_holder] -->    that this Online Service Contract memorializes in writing the specific terms of Customer\u2019s<!-- [et_pb_line_break_holder] -->    subscription<!-- [et_pb_line_break_holder] -->    to<!-- [et_pb_line_break_holder] -->    unWired Standard Internet Service that will be in effect after installation. Customer further<!-- [et_pb_line_break_holder] -->    understands,<!-- [et_pb_line_break_holder] -->    acknowledges, and agrees that this Online Order Form and <a<!-- [et_pb_line_break_holder] -->      href=&#8221;\/master-services-agreement&#8221;>MSA <\/a><!-- [et_pb_line_break_holder] -->    shall be<!-- [et_pb_line_break_holder] -->    effective as of, and shall govern the<!-- [et_pb_line_break_holder] -->    terms of Customer\u2019s subscription with unWired as of the Installation Date.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">In consideration for the Services, Customer acknowledges that it will receive<!-- [et_pb_line_break_holder] -->    benefits,<!-- [et_pb_line_break_holder] -->    sometimes including but not limited to reduced monthly service fees. Accordingly, upon early<!-- [et_pb_line_break_holder] -->    termination<!-- [et_pb_line_break_holder] -->    of the<!-- [et_pb_line_break_holder] -->    Contract during the Contract Term, Customer shall pay the ETF amount, a sum of which the Customer<!-- [et_pb_line_break_holder] -->    agrees<!-- [et_pb_line_break_holder] -->    represents a reasonable approximation of unWired&#8217;s damages for early termination and is not a<!-- [et_pb_line_break_holder] -->    penalty or<!-- [et_pb_line_break_holder] -->    forfeiture. Customer must provide notice of early termination according to the requirements in<!-- [et_pb_line_break_holder] -->    Section 7<!-- [et_pb_line_break_holder] -->    of the <a href=\"\/master-services-agreement\">MSA<!-- [et_pb_line_break_holder] -->    <\/a>.<!-- [et_pb_line_break_holder] -->    If<!-- [et_pb_line_break_holder] -->    via<!-- [et_pb_line_break_holder] -->    email <a href=\"mailto:billing@getunwired.com\">(billing@getunwired.com)<\/a>, or postal mail to<!-- [et_pb_line_break_holder] -->    unWired<!-- [et_pb_line_break_holder] -->    Broadband, Inc., 215 W. Fallbrook Ave., Ste. 203, Fresno, CA 93711, or by calling unWired Customer<!-- [et_pb_line_break_holder] -->    Care<!-- [et_pb_line_break_holder] -->    at<!-- [et_pb_line_break_holder] -->    559-261-4444.<!-- [et_pb_line_break_holder] -->  <\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer acknowledges that additional charges, such as a Technician Roll-Out<!-- [et_pb_line_break_holder] -->    Charge of<!-- [et_pb_line_break_holder] -->    $170.00, may be assessed if the Customer cancels the agreed upon installation appointment with less<!-- [et_pb_line_break_holder] -->    than<!-- [et_pb_line_break_holder] -->    24-hour<!-- [et_pb_line_break_holder] -->    notice or requires additional service trips due to Customer being unprepared for the installation.<!-- [et_pb_line_break_holder] -->  <\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer understands, acknowledges and agrees that Customer is required to provide<!-- [et_pb_line_break_holder] -->    electrical<!-- [et_pb_line_break_holder] -->    power and a continuous<!-- [et_pb_line_break_holder] -->    connection to the power grid to unWired Internet Equipment at all times (including when Customer is<!-- [et_pb_line_break_holder] -->    not<!-- [et_pb_line_break_holder] -->    using<!-- [et_pb_line_break_holder] -->    the<!-- [et_pb_line_break_holder] -->    Service) and that Customer\u2019s failure to provide such power and continuous connection may result in<!-- [et_pb_line_break_holder] -->    damage to the<!-- [et_pb_line_break_holder] -->    unWired<!-- [et_pb_line_break_holder] -->    Internet Equipment or to Customer\u2019s computer, equipment, property or premises, which will be<!-- [et_pb_line_break_holder] -->    Customer\u2019s<!-- [et_pb_line_break_holder] -->    sole<!-- [et_pb_line_break_holder] -->    responsibility.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer understands, acknowledges and agrees that prior to unWired servicing any<!-- [et_pb_line_break_holder] -->    Customer<!-- [et_pb_line_break_holder] -->    equipment or unWired Equipment under contract with Customer, it is Customer\u2019s responsibility to (A)<!-- [et_pb_line_break_holder] -->    back-up the<!-- [et_pb_line_break_holder] -->    data, software, information or other files stored on Customer\u2019s\/Subscriber\u2019s computer, tablet or<!-- [et_pb_line_break_holder] -->    other<!-- [et_pb_line_break_holder] -->    device<!-- [et_pb_line_break_holder] -->    including but not limited to disk drives, peripherals, MP3 player, DVD player, camcorder, digital<!-- [et_pb_line_break_holder] -->    camera<!-- [et_pb_line_break_holder] -->    and\/or<!-- [et_pb_line_break_holder] -->    on any other electronic storage device; and (B) remove all videotapes, compact disks, floppy disks,<!-- [et_pb_line_break_holder] -->    laser disks,<!-- [et_pb_line_break_holder] -->    cassettes, DVDs, film or other media from Customer\u2019s equipment. Customer agrees that whether or not<!-- [et_pb_line_break_holder] -->    Customer<!-- [et_pb_line_break_holder] -->    requests back-up services from unWired and\/or its Operational Service Provider(s), neither unWired<!-- [et_pb_line_break_holder] -->    nor<!-- [et_pb_line_break_holder] -->    its<!-- [et_pb_line_break_holder] -->    Operational Service Provider(s) shall be liable under any circumstances for any loss, disclosure,<!-- [et_pb_line_break_holder] -->    alteration or<!-- [et_pb_line_break_holder] -->    corruption of any data, software, information, files, videotapes, compact disks, floppy disks, laser<!-- [et_pb_line_break_holder] -->    disks,<!-- [et_pb_line_break_holder] -->    cassettes, DVDs, film or other media.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer acknowledges that it has read, understands, and agrees to this Online<!-- [et_pb_line_break_holder] -->    Order<!-- [et_pb_line_break_holder] -->    Form, the <a href=\"\/master-services-agreement\">MSA<\/a>,<!-- [et_pb_line_break_holder] -->    the<!-- [et_pb_line_break_holder] -->    <a href=\"https:\/\/www.getunwired.com\/unwired-privacy-policy\"> Privacy Policy,<\/a> the <a<!-- [et_pb_line_break_holder] -->      href=&#8221;https:\/\/www.getunwired.com\/unwired-broadband-open-internet-policy&#8221;>Open Internet<!-- [et_pb_line_break_holder] -->      Transparency<!-- [et_pb_line_break_holder] -->      Statement<\/a>, the <a href=\"https:\/\/www.getunwired.com\/aup\">Acceptable Use Policy<\/a> and other<!-- [et_pb_line_break_holder] -->    documents<!-- [et_pb_line_break_holder] -->    incorporated by reference in the <a<!-- [et_pb_line_break_holder] -->      href=&#8221;\/master-services-agreement&#8221;>MSA<\/a>.<!-- [et_pb_line_break_holder] -->  <\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer agrees that Customer is required to pay all applicable federal, state,<!-- [et_pb_line_break_holder] -->    and<!-- [et_pb_line_break_holder] -->    local<!-- [et_pb_line_break_holder] -->    taxes and fees, including, but not limited to, those imposed after the date of execution of this<!-- [et_pb_line_break_holder] -->    Online<!-- [et_pb_line_break_holder] -->    Order<!-- [et_pb_line_break_holder] -->    Form.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer understands that Customer is responsible for maintaining current payment<!-- [et_pb_line_break_holder] -->    and<!-- [et_pb_line_break_holder] -->    contact<!-- [et_pb_line_break_holder] -->    information with unWired using the unWired Customer Hub <a<!-- [et_pb_line_break_holder] -->      href=&#8221;https:\/\/hub.myunwired.com&#8221;>(https:\/\/hub.myunwired.com)<\/a>.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer agrees to pay the Monthly Recurring Fee indicated above for each month of<!-- [et_pb_line_break_holder] -->    the<!-- [et_pb_line_break_holder] -->    Service<!-- [et_pb_line_break_holder] -->    Term. The Due Date for all payments are twenty (20) calendar days after invoice date when paying by<!-- [et_pb_line_break_holder] -->    check or due<!-- [et_pb_line_break_holder] -->    upon receipt if paying by credit card. All payments received ten (10) calendar days past the Due<!-- [et_pb_line_break_holder] -->    Date<!-- [et_pb_line_break_holder] -->    for<!-- [et_pb_line_break_holder] -->    Standard Internet Services will be considered late and subject to a $10.00 Late Fee for each month<!-- [et_pb_line_break_holder] -->    overdue.<!-- [et_pb_line_break_holder] -->    Accounts past due fifteen (15) calendar days or more may be suspended without notice. All accounts<!-- [et_pb_line_break_holder] -->    shut<!-- [et_pb_line_break_holder] -->    off for<!-- [et_pb_line_break_holder] -->    non-payment or suspended outside of Service Contract terms may be subject to a Service Reinstatement<!-- [et_pb_line_break_holder] -->    Fee<!-- [et_pb_line_break_holder] -->    of<!-- [et_pb_line_break_holder] -->    $25.00.<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">Customer authorizes unWired\u2019s Authorized Parties, to enter onto the Property to<!-- [et_pb_line_break_holder] -->    install and<!-- [et_pb_line_break_holder] -->    maintain unWired Equipment necessary for Customer to receive the Services. Customer represents and<!-- [et_pb_line_break_holder] -->    warrants to<!-- [et_pb_line_break_holder] -->    unWired that Customer has full authority to enter into this Service Contract, without obtaining<!-- [et_pb_line_break_holder] -->    approval<!-- [et_pb_line_break_holder] -->    of any<!-- [et_pb_line_break_holder] -->    other person, and acknowledges that unWired is replying upon such representation and warranty to<!-- [et_pb_line_break_holder] -->    proceed<!-- [et_pb_line_break_holder] -->    with<!-- [et_pb_line_break_holder] -->    installation of any required unWired Equipment. Customer agrees to indemnify unWired for any<!-- [et_pb_line_break_holder] -->    liability<!-- [et_pb_line_break_holder] -->    arising<!-- [et_pb_line_break_holder] -->    out of or in any way connected to acts reasonably preformed by unWired\u2019s Authorized Parties in<!-- [et_pb_line_break_holder] -->    reliance<!-- [et_pb_line_break_holder] -->    on<!-- [et_pb_line_break_holder] -->    Customer\u2019s representations of authority. Additionally, in the event that unWired arrives on location<!-- [et_pb_line_break_holder] -->    for<!-- [et_pb_line_break_holder] -->    the<!-- [et_pb_line_break_holder] -->    installation of the unWired Equipment, of activation of the Services, and the Customer does not or<!-- [et_pb_line_break_holder] -->    did<!-- [et_pb_line_break_holder] -->    not have<!-- [et_pb_line_break_holder] -->    the authority to authorize the installation, resulting in unWired having to remove equipment,<!-- [et_pb_line_break_holder] -->    relocate<!-- [et_pb_line_break_holder] -->    its<!-- [et_pb_line_break_holder] -->    equipment or reschedule the installation, Customer may be subject to a \u201cTechnician Roll-out Charge\u201d<!-- [et_pb_line_break_holder] -->    of<!-- [et_pb_line_break_holder] -->    ONE<!-- [et_pb_line_break_holder] -->    HUNDRED SEVENTY DOLLARS ($170.00 US).<\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\"><!-- [et_pb_line_break_holder] -->    CUSTOMER UNDERSTANDS, ACKNOWLEDGES, AND AGREES THAT THE <a<!-- [et_pb_line_break_holder] -->      href=&#8221;\/master-services-agreement&#8221;>MSA <\/a><!-- [et_pb_line_break_holder] -->    REQUIRES THE<!-- [et_pb_line_break_holder] -->    USE OF ARBITRATION ON AN INDIVIDUAL<!-- [et_pb_line_break_holder] -->    BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND ALSO LIMITS THE REMEDIES<!-- [et_pb_line_break_holder] -->    AVAILABLE TO<!-- [et_pb_line_break_holder] -->    CUSTOMER IN THE EVENT OF A DISPUTE.<!-- [et_pb_line_break_holder] -->  <\/pee><!-- [et_pb_line_break_holder] -->  <pee class=\"terms-info\">CUSTOMER UNDERSTANDS, ACKNOWLEDGES AND AGREES THAT UNWIRED REGULARLY UPDATES AND<!-- [et_pb_line_break_holder] -->    AMENDS THE <a href=\"\/master-services-agreement\">MSA <\/a><!-- [et_pb_line_break_holder] -->    AND<!-- [et_pb_line_break_holder] -->    THAT CUSTOMER WILL BE BOUND BY THE TERMS OF THE <a<!-- [et_pb_line_break_holder] -->      href=&#8221;\/master-services-agreement&#8221;>MSA <\/a><!-- [et_pb_line_break_holder] -->    AS THEN-IN-EFFECT UPON NOTICE OF SUCH CHANGES UNLESS<!-- [et_pb_line_break_holder] -->    FURTHER NOTICE OR STEPS ARE REQUIRED BY LAW.<!-- [et_pb_line_break_holder] -->  <\/pee><!-- [et_pb_line_break_holder]
